Terms of Use

This terms of use agreement (hereafter referred to as Agreement), constitutes a legally binding agreement made between you (hereafter referred to as Consumer), and SNABiotech (hereafter referred to as Provider). encompassing Provider and all Provider assets including Websites, Software Applications, Software Tools, and all other digital assets associated to Provider and Provider products (hereafter referred to as Product). The products associated to Neurosage Home and all ancillary digital assets are directly and indirectly implied and incorporated into these terms of use and Product definition. Supplemental terms and conditions or documents that may be posted online or sent in digital format directly to Consumer are herby expressly incorporated into this Agreement by reference.

Company makes no representation that the Product is appropriate or available in other formats or locations other than where is expressly operated by and defined for use by Provider. The information, digital assets, and all express or implied content provided through the Product is not intended for distribution to or use by any person or entity in any local jurisdiction or country beyond the immediate vicinity of Consumer or where use or distribution would be contrary to laws or regulations or which would subject Provider to any registration or monetary requirements with such jurisdiction, country, or government entity. Accordingly, if Consumer chooses to access the Product from other locations the Consumer does so on their own initiative and are solely responsible for compliance with local laws, if and to the extent that local laws are applicable.

All Consumers who are minors in the jurisdiction which they reside (generally under the age of 18) are not permitted to register for the Product or use any Provider resources without express approval by and registration for Product with Provider by an approved and registered Consumer.

YOU ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT BY ACKNOWLEDGING SUCH ACCEPTANCE DURING THE REGISTRATION PROCESS AND ALSO BY CONTINUING TO USE AND PAY FOR CONTINUED USE OF THE PRODUCT. IF YOU DO NOT AGREE TO ABIDE BY THIS AGREEMENT OR TO MODIFICATIONS THAT PROVIDER MAY MAKE TO THIS AGREEMENT IN THE FUTURE, DO NOT USE OR ACCESS OR CONTINUE TO USE OR ACCESS THE PRODUCT.

Neurosage Subscribers are automatically charged once a month on the date of signed up. A Neurosage Subscription is charged at the beginning of the billing cycle and can take several days to appear on your account. Your billing date may be 1 day earlier or later due to time zone differences.

If the day of your billing date does not occur in every month (for example, the 31st), you will be billed on the last day of that month instead.

Regarding you registration.

By using the Product, you represent and warrant that:

You also agree to: a) provide true, accurate, current and complete information about yourself as prompted by Provider registration form, process, or requests and b) maintain and promptly update registration data to keep true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or Provider has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Provider has the right to suspend or terminate your account and refuse any and all current or future us of the Product (or any portion thereof).

We reserve the right to remove or reclaim or change a user name you select if we determine appropriate in our discretion, such as when the user name is obscene or otherwise objectionable or when a trademark owner complains about a username that does not closely relate to a Consumers actual name.

Consumer License

Registration and purchase of Product grants Consumer a revocable, non-exclusive, non-transferrable, limited right to install and use Product on appropriate and approved wired and/or wireless digital devices and/or platforms owned and controlled by Consumer and to access and use Product on such devices strictly in accordance with the terms and conditions of this license. You shall use the Product strictly in accordance with the terms of this license and shall not a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Product; b) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Product; c) violate any applicable laws, rules, or regulations in connection with your access or use of the Product; d) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Provider or it’s affiliates, partners, suppliers, or the licensors of the Product; e) use the Product for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended as defined by Provider; f) make the Product available over a network or other environment permitting access or use by multiple devices or Consumers at the same time; g) use the Product or Product related Intellectual Property for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the Product; h) use the Product to send or receive automated queries to any other platform, product, or digital device or to send any unsolicited commercial email; or I) use any proprietary information or interfaces of Provider or Provider Product or other intellectual property of Provider or Provider Product in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices.

You may not access or use the Product for any other purpose than that for which the Provider defines and makes it available. The Product may not be used in connection with any commercial endeavors except those that are specifically defined by and endorsed by Provider.

All content and digital assets associated with and pertaining to Product and the trademarks, service marks, and logos contained therein are owned by and/or licensed by Provider and are subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content and digital assets include without limitation all source code, databases, functionality, software, websites, designs, audio, video, text, photographs, and graphics. All Product graphics, photos, logos, designs, buttons, icons, scripts, and service names are registered trademarks given or pending, common law trademarks, or trade dress of Product in the United States and/or other countries. Product trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission and consent of the Provider.

This Agreement will remain active and in full force while you use the Product or are otherwise in any other way engaged with the Provider or any/all Provider assets, products, or services. You may terminate your use or participation at any time, for any reason, by following the instructions for terminating Consumer accounts in your account settings, if available, or by contacting Provider by provided Provider contact information.

WITHOUT LIMITING ANY OTHER PROVISION OF THIS AGREEMENT, PROVIDER RESERVES THE RIGHT TO, IN PROVIDERS SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF PRODUCT AND/OR PRODUCT RELATED DIGITAL ASSETS AND PROVIDER SERVICES, TO ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THIS AGREEMENT, OR ANY APPLICABLE LAW OR REGULATION, AND PROVIDER MAY TERMINATE YOUR USE OF PRODUCT OR PROVIDER RELATED SERVICES AND/OR PLATFORMS, DELETE YOUR ACCOUNT, PROFILES, OR DIGITAL DATA THAT YOU HAVE PROVIDED AT ANY TIME WITHOUT WARNING, IN PROVIDERS SOLE DISCRETION.

In order to protect the integrity of Provider Product, Provider services, and Provider digital environments, Provider reserves the right at any time in its sole discretion to block certain IP addresses from accessing Provider Product, digital assets, and services.

If Provider terminates or suspends your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on the behalf of the third party. In addition to terminating or suspending your account, Provider reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

IN NO EVENT SHAL PROVIDER OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THRID PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA OR OTHER DAMAGES ARISING FROM YOUR USE OF PRODUCT OR PROVIDER RELATED SERVICES. EVEN IF PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, PROVIDERS LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO PROVIDER FOR THE PRODUCT OR PROVIDER SERVICES DURING THE PERIOD OF CONTRACTED USE OF PRODUCT.
